DOLE ZCFO organizes ITCs for Security and Manpower Agencies

Are you a security guard posted in a private establishment for 12 hours a day, 7 days a week and receives only P150.00 as daily wage? Or a saleslady deployed in a bazaar, standing for long hours except for lunch break, and paid only P180.00 for each day? Or a farm hand who has to ensure that the chicken, pigs or plants you are tending survive and are ready for sale once they reach marketable age or else be charged by farm operators for their actual cost plus damage fee?

There are still other conditions that will make up a long list of violations in workplaces, and many workers in this commercial center of Zamboanga Peninsula share the same plight. But these things have not gone unnoticed by the concerned government agency, the Department of Labor and Employment. The department introduces innovations from time to time in order to meet the needs of the time. For instance, in 2014 the Labor Inspection System was replaced by the Labor Laws Compliance System (LLCS), a new system that adapts a tripartite approach, thereby eliminating possible offhand transactions between government and management by ensuring participation of workers in affairs that affect their welfare at work, be it monetary in nature or pertaining to their safety and health.

To complement the efforts of Labor Laws Compliance Officers (LLCOs) under the LLCS, the DOLE-Zamboanga City Field Office (ZCFO) on February 12 and 13, 2015 gathered 52 operators and security guards from 21 security agencies, and 68 representatives from 32 manpower agencies providing farming, hauling and distribution services, respectively for learning sessions at Grand Astoria Hotel, this city.

The activity was aimed at familiarizing these agencies on Department Order (D.O.) No. 18-A and its implementing Rules. D.O. 18-A protects workers by curbing abuses of contracting and subcontracting arrangements and has provisions that would strengthen security of tenure of workers, particularly prohibiting the repeated hiring of workers for a five-month period, known as “5-5-5” and “end of contract”.

The organization of the Industry Tripartite Councils (ITC) capped the 2-days orientations. Elected ITC chair for Security Agencies is Mr. Danilo Carreon of D’ Ranger Security Agency while Mr. Victor Advincula was voted Chair for Manpower Agencies. Workers’ representatives sitting as Vice-Chair were also elected with Ralph Mayo for Manpower Services and Security Guards Viado Dumanta and Benjie Ejona for Security Services.

The ITCs shall serve as DOLE’s support systems in the implementation of the program in the city as well as in other areas where they have branch offices. As individual establishments, operators are primarily tasked to adhere to the minimum standards set forth in the Labor Code of the Philippines, as amended and therefore, refrain from engaging in service contracts with principals who offer less than what is provided for by law. As an organization, the ITC is charged to look out for members or operators who infringe the law and put the welfare of workers at stake.

“This is our dream to professionalize the industry, rest assured that we will be active to uplift the lives of our workers”, says ITC Chairperson Carreon during the closing ceremony.

Action planning exercises on major activities to be implemented by the ITCs within the year is slated at the end of this month.
